Spring is here! As the days get warmer we start cleaning up our yards, I would like to remind everyone to use caution when burning yard waste.   If the wind is blowing or we haven’t had any moisture - do not burn.  We have had a lot of low humidly days with high winds this spring – the national weather service issues Red Flag Warnings on these days-no outdoor burning.  Also when the conditions call for breezy and gusting winds or dry conditions, they also recommend no outdoor burning.  The city of Plattsburg follows these guidelines for outdoor burning.  Every major news station in KC will announce these conditions on their local forecast, plus the Nation Weather Service publishes these conditions on their web site:   http://www.weather.gov/eax/  

I thought it would be a good idea for everyone to see a portion of our city ordinance that covers outdoor burning:

Section.  210.590   Prohibited Outdoor burning.

[Ord. No. 1438, 1-10-2001; Ord. No. 1571, 2-12-13]

  1.  Generally, outdoor burning of the following material is prohibited within in the corporate limits of the City: Asbestos; Garbage; Hazardous or highly flammable material; Organic allergens; Rubbish; Trade waste.
  2. Burning During Unfavorable Meteorological Conditions.  No outdoor burning of any type will be conducted during unfavorable meteorological conditions including, but not limited to, temperature inversions, periods of drought or extreme dry weather, high winds or air stagnation.  The Mayor is hereby authorized and empowered to issue a ban to prohibit all outdoor burning during unfavorable meteorological conditions, which prohibition shall be announced by posting a notice at City Hall, a publication, as soon as reasonably practical on the City’s web site, in local newspapers of general circulation or press releases to local media.  Violations of this section constitute a misdemeanor for which fines and penalties maybe issued.
  3. Burning on Streets and Alleys Prohibited.  No burning of any kind shall be conducted on the right-of -way of any public street, road, ally or highway.
  4. Burning in Ditches, Drainage Tubes and Culverts Prohibited.  No burning of any type shall be conducted in any ditch, tube, culvert or other conveyance designed to direct or carry away an accumulation of rain or surface water located in any right of way or easement dedicated to the City.
  5. Prohibited Conduct:
    1. No person shall cause, suffer or permit any outdoor burning whatsoever if said burning is in violation of the section.
    2. No person shall in any manner hinder, delay, resist, prevent or interfere with any public employee, Fire Department personnel or Law Enforcement Officer, after proper identification, entrance at reasonable hours to any premises.  
    3.  Penalties.  Any person violating any of the provisions in this Section shall, upon conviction therefore by the Municipal Court Judge or any Judge of concurrent jurisdiction be sentence to pay a fine of not less than $25.00 nor more than $100 together with costs for the first violation.  Subsequent violations may be fined up to $500, together with costs.  In default in the payment of any fine imposed hereunder, the defendant may be sentenced to jail for a period not exceeding 30 days.    

 

This ordnance is in effect for everyone’s safety-no one wants set a house or property on fire because of outdoor burning when it is not safe.  If you are not sure of restrictions on outdoor burning on a particular day: you can call City Hall; the Fire Department; or our check our web site at; http://www.plattsburgmo.com/City/
